American Way of Law: a Constituição dos Estados Unidos como norte no ideário da nova direita jurídica brasileira

Closely linked to Bolsonarism, a new legal right has engaged in the Brazilian public debate, championing views similar to those of the former president. This article discusses a pivotal aspect of the ideology of this intellectual network: its enormous fondness for the constitutionalism of the United States of America. The article demonstrates how the new legal right idealizes American Law and claims some of its elements in the name of contemporary political conflicts in Brazil. The first section elucidates how, by idolizing the United States Constitution, the new legal right resonates with the powerful trope of American exceptionalism. The two following sections examine how the American legal framework regarding freedom of expression and the right to keep and carry arms is rhetorically invoked to support Bolsonaro's interests and policies. Finally, the article emphasizes how the First and Second Amendments to the American Constitution have become symbols of the new Brazilian right.
